Transitional Justice in Latin America — The Uneven Road from Impunity towards Accountability studies the tension between impunity and accountability, and the trajectory from one towards the other, in nine transitional justice country cases: Argentina, Uruguay, Brazil, Chile, Paraguay, El Salvador, Guatemala, Peru and Colombia. It analyses four specific transitional justice mechanisms TJMs for each case: amnesty, trials, truth finding and reparations. In doing so, it separates the cases between those related to post-authoritarian regimes Argentina, Chile, Uruguay, Brazil, Paraguay , those coming out of armed conflict El Salvador, Guatemala, Peru and a special case located at a pre-transitional stage, i. Each chapter covers the four TJMs in some detail, examining how the country used each one of them and how controversial they were. At the end of each chapter, the authors present accountability graphs for each mechanism and overall accountability.
This chapter addresses national and international efforts of post-conflict reconstruction and reconciliation in societies emerging from armed conflict or authoritarian regimes. Such efforts place great emphasis on the need for accountability for past human rights violations. The assumption behind these efforts is that justice must be addressed if the goal is a stable, long-lasting peace. The chapter addresses the main transitional justice mechanisms applied by countries seeking to establish some form of accountability for past violations: prosecutions, truth commissions, and victim reparations, providing examples from specific transitional justice experiences in Latin America. When archives do exist, they do not usually identify individual perpetrators or victims, nor do they directly establish criminal responsibility. This article focuses on two criminal trials that unfolded in Argentina and Italy and closely probed the atrocities of Operation Condor. It contends that archival documents only contain remnants of truth and fragments of evidence. These slivers have to be interpreted, contextualized, and sometimes even questioned in order to render them relevant and useful to criminal investigations of past atrocities. Specifically, the article deconstructs the role that different trial actors—including public and private prosecutors, archivists, experts, witnesses, lawyers, and judges—played in the courtroom, engaging in proactive efforts to piece together the evidence that archival records possess and activating their content.
